Terms and Conditions

These Terms and Conditions constitute the agreement between Hostel SS and the Residents for the provision of long-term residential accommodation services near Manipal University, Jaipur. By staying at our facility, you agree to abide by the following terms.

1. Resident Accommodation Services & Facility Details

1.1 This Application Form, together with these Standard Terms and Conditions, forms a contract on a license basis between Hostel SS and the Resident. Hostel SS agrees to provide long-term residential accommodation services at the Facility for the Contract Period, and the Resident agrees to accept these services subject to the terms herein.

1.2 The Facility Address is as set out in Schedule I of the contract.

2. Facility Admission & Charges Policy

2.1 Admission to the Facility is provisional and subject to payment of Facility Charges as outlined in the admission form.

2.2 Accommodation services are available on a ‘First-Come-First-Serve’ and ‘Subject to Availability’ basis. Hostel SS reserves the right of admission.

2.3 A seat in the Facility is not guaranteed until the Resident completes all enrolment requirements, including payment of Facility fees and submission of required documents, by the Cut-Off Date specified in the Enrolment Form.

2.4 Facility Charges: Residents must pay the facility fee as specified in the admission form, along with an interest-free refundable deposit, in advance at the time of admission. Rent must be paid on the due date. Failure to do so may result in the management deciding on the continuation of the Resident’s tenancy. Payments must be made only to the official company account. No payments will be accepted in personal accounts, and cash or cheque payments are strictly prohibited. Hostel SS is not responsible for payments made to any account other than the official company account.

2.5 Refundable Security Deposit: An interest-free Refundable Security Deposit is charged at the time of admission, from which deductions for the Resident’s liabilities may be made. The Security Deposit will be forfeited without notice if the Resident fails to complete enrolment requirements by the Cut-Off Date or vacates/abandons the Facility during the tenure. The deposit, subject to deductions, will be returned upon due completion of the Contract Period. If a Resident is asked to vacate due to malpractice or rent delay, the Security Deposit will not be refunded. Refunds will be processed within 30 days from the date of leaving the property.

2.6 Refund Policy: If the Facility becomes unoperational due to regulatory, legal, structural, or similar issues, Facility Management will refund Facility Charges for the unexpired period. No refunds will be issued for college closures due to events like COVID-19, and Residents are obligated to pay rent during such periods. Default in rent payment will lead to contract cancellation and forfeiture of the Security Deposit.

3. Admission Rules

3.1 Duration of Stay: The duration of stay depends on the Resident’s academic year.

3.2 Room Allotment: Upon payment of Facility Charges, a room is allotted on a leave-and-license basis. Residents may not interchange rooms or shift to vacant rooms/beds without written permission from Facility Management, which reserves the right to reassign rooms.

3.3 No Creation of Tenancy: No tenancy or similar rights are created by occupying or using the Facility. Residents are permitted to temporarily stay, subject to compliance with these terms.

3.4 Safety and Personal Belongings: Facility Management provides keys to allotted rooms. Residents are responsible for the safety of their valuables, which should be kept locked. Residents must not change locks without permission and should guard against key loss.

3.5 Furniture & Fixtures: Residents may not bring extra furniture or fixtures. They must care for provided furniture and fixtures and will be liable for the original cost of damaged or missing items due to negligence or misuse. Interchanging furniture/fixtures or damaging common area assets will result in penalties.

3.6 Electricity Restrictions: Electric appliances are not permitted in rooms, and violations may lead to confiscation. Lights, air-conditioners, and fans must be switched off when not in use, with fines imposed for non-compliance.

3.7 Room Checking: Facility Management or officials may inspect rooms or Residents’ belongings in the presence of Residents at any time.

3.8 Storage of Baggage During Vacation: Belongings must be locked in cupboards during vacations. Residents may use common storage facilities for limited quantities, subject to informing Facility Management one month prior. Belongings must be removed at the end of the Contract Period unless renewed.

3.9 Identity Card: Residents must carry Facility-issued identity cards when leaving the Facility and cooperate with security personnel for verification.

4. Specially Abled Disclosure

4.1 Residents must disclose any special needs or medical conditions at the time of signing the Application Form. Non ~ System: -disclosure or inaccurate information may void the contract, and any Facility Charges or Security Deposit paid will be forfeited.

5. Attendance, Facility Timings, Leave, and Visitors

5.1 Attendance Register: Attendance is recorded daily between 10:00 pm and 10:30 pm (11:30 pm on Sundays/Holidays). Residents must sign the attendance register or provide biometric records. Leaving the Facility after these hours without parent/guardian permission will result in disciplinary action.

5.2 Returning to Facility: Residents must return by 11:00 pm (11:30 pm on Saturdays/Sundays/Holidays), after which gates are closed. Latecomers must register at the gate, and their institute, parents, and local guardians will be informed.

5.3 Celebration of Festivals and Birthdays: Prior permission from Facility Management is required for celebrations, which must occur in common areas for one to two hours and not disturb other Residents. No outside guests are allowed.

5.4 Leave Policy: Night outs are permitted only with written consent from Facility Management and parents/local guardians, or on holidays. Residents must return after 6:00 am. In medical emergencies, Residents may contact Facility Management directly.

5.5 Visitors/Parents/Guardians: Visitors, including parents, are restricted to common areas. Personal servants or helpers are not allowed in rooms. Visitors causing disturbances will be denied further access.

5.6 Local Guardian: Residents must register a local guardian, authenticated by parents, who will sign a copy of Facility rules.

5.7 Medical Treatment: Residents with medical insurance must share policy details. Facility Management provides first aid. In medical emergencies, Residents will be referred to a hospital, with costs borne by their guardians.

6. Mess and Dining Facility

6.1 Inspection: Facility Management will set the menu, inspect food quality, and maintain records for improvement.

6.2 Serving of Food: Food is served only in the mess as per set timings. Residents may not take food or utensils to rooms, with penalties for violations. Food may be served to Residents unable to visit the mess due to illness.

6.3 Wastage of Food: Only mess members may dine in the mess. Outside food is prohibited. Residents must inform the Mess Supervisor in advance of absences to avoid food wastage. Waste food and utensils must be placed in designated bins.

6.4 Sick Diet: Subject to availability, ill Residents may request a sick diet (e.g., light/oil-less food) from Facility Management.

6.5 Guests: Guests may dine in the mess only with prior permission and payment of applicable charges.

8. Civil Repairs

8.1 Residents must report maintenance needs (civil, carpentry, electrical) to Facility Management and cooperate by vacating rooms when required for repairs.

8.2 Reporting Undesirable Activity: Residents must report any unwanted incidents or activities to Facility Management.

9. Strictly Prohibited Activities

9.1 Ragging: Ragging is banned and is a cognizable offense. Participation, failure to report, or undergoing ragging will result in disciplinary action, including expulsion.

9.2 Alcohol/Drugs/Smoking: Possession, consumption, or distribution of alcohol, drugs, or smoking materials is prohibited, with violations leading to expulsion and legal action.

9.3 Gambling: Gambling is prohibited and may result in expulsion and legal action.

9.4 Misuse of Internet and Social Media: Uploading derogatory content about the Facility or others will result in disciplinary action.

9.5 Political or Communal Activity: Residents must not engage in political or communal activities that disrupt law and order.

9.6 Information to the Media: Residents must obtain written permission from Facility Management before sharing Facility-related information with media.

9.7 Assault: Physical assault on Residents or staff will result in disciplinary action.

9.8 Firearms: Firearms, ammunition, explosives, and inflammable goods are prohibited, with violations leading to expulsion.

9.9 Pets: Pets, including fish, cats, and dogs, are not allowed. Residents should not feed or pamper stray animals.

10. Violation of Facility Rules

10.1 Disciplinary Actions: Violations of Facility rules will result in penalties, punishments, or fines as per Facility Rules.

10.2 Recovery of Damage/Losses: Damages to common property will be recovered from responsible Residents or collectively from all Residents if responsibility cannot be pinpointed.

10.3 Expulsion from Facility: Facility Management may terminate occupancy for willful disobedience, non-compliance, or anti-social activities, with forfeiture of the deposit and no refund of Facility fees.

11. Limitation of Liability

11.1 The Facility is not liable for death or personal injury due to its negligence.

11.2 Neither party is liable for special, indirect, or consequential losses.

11.3 The Facility’s total liability shall not exceed the Facility Charges collected from the Resident.

12. Force Majeure

12.1 The Facility is not responsible for events beyond its control, such as natural calamities or unavoidable reasons (“Force Majeure”).

12.2 If a Force Majeure event persists for 30 days, the Facility may terminate the agreement and refund Facility Charges and Security Deposit for the unexpired period. This does not apply to shutdowns due to COVID-19.

13. Suggestion Box/Register

13.1 Residents may submit suggestions or complaints via the Suggestion Box or Register on the Facility premises.

14. Governing Law and Dispute Resolution

14.1 This Agreement is governed by the laws of India, with exclusive jurisdiction in the courts of the National Capital Territory of Delhi.

14.2 Disputes will be resolved through arbitration in Delhi under the Arbitration and Conciliation Act, 1996, by a one-member panel, conducted in English, with the award being final and binding.

Acceptance of Terms

By residing at the Facility, Residents acknowledge and agree to these Terms and Conditions. The minimum length of stay is one academic year. If shortened, the entire Security Deposit will be forfeited.
